Understanding overtime calculation
Overtime refers to hours worked beyond the standard weekly working schedule. They entitle employees to a salary premium or, in some cases, compensatory rest. Our tool automates the calculation.
Legal premium rates
The Labor Code provides for two premium tiers: +25% for the first 8 overtime hours (36th to 43rd hour) and +50% from the 44th hour onwards. A sector or company agreement may provide for different rates, but never less than 10%.
Annual overtime quota
The annual quota for overtime is set at 220 hours per employee per year (unless a collective agreement specifies otherwise). Beyond this quota, the employer must seek the opinion of the social and economic committee (CSE) and grant mandatory compensatory rest.
Tax exemption for overtime
Since January 2019, overtime pay is exempt from income tax up to €7,500 per year. It also benefits from a reduction in employee contributions. These measures aim to reward work beyond 35 hours.
